Scratched Glass Possibly Fabricating Debris

We just completed a commercial new construction job with tempered glass manufactured by Western States Glass and sure enough there are scratches which we are being blamed for. Once we discovered the scratches we did several windows without a blade at all to see if it in fact was our blades and there were still scratches on the glass. The large panes also had a large 3 ft X 6" streak mark down the middle of each pane which the manufacturer is able to buff out( manufacturer said it was from the furnace rollers). There was a meeting between the building owner, contractor, window installer and glass manufacturer that we were not told about and they all agreed it was the window cleaner who scratched the glass. The customer wants us to fix or replace the glass. So my questions here is advice on this, is there a fabricating debris expert that can determine the scratches, is there much success for the window cleaner in litigation with the scratched glass issue, should we just try scratch removal systems to fix the windows? Not sure where to go and what to do on it, very confident though that it is fabricating debris and no we didn't have a waiver signed (our company policy has now changed - NO NEW CONSTRUCTION WITHOUT THE WAIVER) . Also does anyone have history with Western States Glass. Thank You Alissa Wenning

Alissa,

You say: There was a meeting between the building owner, contractor, window installer and glass manufacturer that we were not told about and they all agreed it was the window cleaner who scratched the glass.

That sounds about right. they didn't want you there PROVING it wasn't you.

Then you say: The customer wants us to fix or replace the glass. So my questions here is advice on this, is there a fabricating debris expert that can determine the scratches?

I specialize in this type of litigation. Please feel free to call me at 925-294-8183 Ext. 201

You ask: Is there much success for the window cleaner in litigation with the scratched glass issue?

I've been VERy succesful with helping get the TRUTH out and put the blame where it belongs, usually with the fabricator.

You ask: Should we just try scratch removal systems to fix the windows?

If this is a tempred glass defect issue, restoration usually doesn't work. Don't make their problem, your problem.

You state: Not sure where to go and what to do on it, very confident though that it is fabricating debris and no we didn't have a waiver signed (our company policy has now changed - NO NEW CONSTRUCTION WITHOUT THE WAIVER).

Having a waiver makes things much easier, but I win almost all my scratched tempered glass cases.

You ask: Also does anyone have history with Western States Glass.

Actually I do and that might help. Give me a call and we can talk.

Thank You Alissa Wenning

Your welcome,
